These terms apply to your use of StayUnbothered.ai (the app) and the website at stayunbothered.ai (together, the Service). The Service is operated by Kelly Burns, trading as StayUnbothered.ai, based in New Zealand (we, us, our).
By creating an account or using the Service you agree to these terms. If you do not agree, please do not use the Service.
We may update these terms at any time. We will notify you by email of any material changes before they take effect. By continuing to use the Service after changes take effect, you agree to the updated terms.
We may also change, suspend, or discontinue the Service at any time without liability.
You must provide accurate and current information when creating your account. You are responsible for keeping your login credentials secure and for all activity under your account. If you become aware of any unauthorised use of your account, notify us immediately at hello@stayunbothered.ai.
The Service provides AI-powered coaching to help you navigate workplace dynamics. It is not therapy, counselling, legal advice, medical advice, or a substitute for professional support of any kind.
If you are experiencing a mental health crisis, please contact a qualified professional or crisis service in your country. If you are dealing with a legal matter, please consult an employment lawyer.
Nothing in the Service constitutes a professional relationship of any kind between you and us.
You agree not to use the Service for any unlawful purpose, attempt to extract or reverse engineer the coaching methodology or scoring logic, use automated tools or scripts to access the Service, share your account with any other person, upload content that is illegal or harmful, or attempt to interfere with or compromise the security of the Service.
You must not upload, submit, or transmit any child sexual abuse material or any content that exploits or harms minors. We will report any such content to the relevant authorities immediately.
We own all intellectual property rights in the Service, including the coaching methodology, branded vocabulary, Power Score framework, and all content we create. Nothing in these terms grants you any rights in our intellectual property.
You own the content you submit to the Service. By submitting content, you grant us a limited licence to process and store it solely for the purpose of providing the Service to you.
Certain features of the Service require a paid subscription. Subscription terms, pricing, and cancellation policies are set out at /pricing. Payments are processed by Stripe. We do not store your payment card details.
If you cancel your subscription, you will retain access until the end of your current billing period.
To the maximum extent permitted by law, you use the Service at your own risk. We make no warranties about the accuracy, completeness, or suitability of the Service for any particular purpose. We are not liable for any loss or damage arising from your use of the Service, including decisions you make based on coaching responses.
Nothing in these terms excludes or limits rights you have under the New Zealand Consumer Guarantees Act 1993 or any other consumer protection law that cannot be excluded. Where our liability cannot be excluded, it is limited to the total amount you paid us in the three months prior to the claim.
We collect and use your personal information in accordance with our Privacy Policy, available at stayunbothered.ai/privacy. We comply with the New Zealand Privacy Act 2020.
We are committed to child safety. Any content that constitutes child sexual abuse material or that exploits or harms minors is strictly prohibited and will be reported to the relevant authorities without delay.
We may suspend or terminate your access to the Service immediately and without notice if we reasonably believe you have breached these terms or if required by law. On termination you must stop using the Service.
You may delete your account at any time from Settings.
These terms are governed by the laws of New Zealand. Any dispute relating to these terms will be subject to the non-exclusive jurisdiction of the New Zealand courts.
